General Terms and Conditions of Sale

Article 1 – Scope of Application

1.1 Definitions

In our contractual relationships with the buyer, we define:

Buyer: any legal or natural person acquiring our products. This person may be a business or an individual. In these general terms and conditions, the buyer will also be referred to as the "customer."

Professional (or business buyer): any buyer purchasing goods or services exclusively for professional purposes.

Individual: any natural or legal person acquiring products for non-professional purposes.

  • Zaventem
  • Wemmel

1.3 Application of the Terms

These general terms and conditions of sale govern the contractual relationship between La Pâte de l'Ours and any customer who initiates a purchase process. Confirmation of the order implies full and unconditional acceptance of these terms and conditions.


Article 2 – Product Characteristics

The photographs and product information presented on the website or social media are not contractually binding. La Pâte de l'Ours cannot be held responsible for any discrepancies between the images and descriptions and the actual product chosen by the customer.


Article 3 – Reservation and Cancellation

3.1 Reservation Process

A reservation is pre-registered upon receipt of a duly dated and signed quote from the customer, with the mention "Agreed" and accompanied by a 25% deposit of the total amount.

3.2 Right of Withdrawal

For any order placed outside our premises, the consumer has seven business days to withdraw from the purchase without penalty, provided they notify the seller via registered mail. The deposit will be refunded within 30 days.

3.3 Short-Term Orders

For orders with a delivery date within 15 calendar days, the quote must be signed at our premises, and the order will be final and binding.


Article 4 – Pricing and Payment Terms

4.1 Prices and Currency

All our prices are in euros and include VAT. The prices stated in the quotes are fixed on the day of the order.

4.2 Payment Methods

Payments can be made via:

  • Bank transfer
  • Credit card
  • PayPal
  • Stripe
  • Cash (only for collection at pick-up points)

4.3 Payment Structure for Individuals

  • Initial deposit: 25% of the total amount (non-refundable)
  • Second deposit: 50% of the total amount, 12 business days before delivery (non-refundable)
  • Balance: 4 days before the delivery date

4.4 Special B2B Conditions

For business orders (B2B), payment terms are subject to a specific agreement between La Pâte de l'Ours and the professional client. These terms are determined on a case-by-case basis and must be clearly communicated and agreed upon in writing.


Article 5 – Delivery and Collection

5.1 Delivery via Bpost

5.1.1 Delivery in Belgium

La Pâte de l'Ours works with Bpost for delivery. Available options:

  • Home or work address delivery
  • Collection at one of the 3,000 Bpost pick-up points
  • 24/7 accessible parcel lockers

Delivery time is generally the next business day after the order.

In case of absence at delivery:

  • A delivery notice will be left
  • Preferences can be set via My bpost
5.1.2 Delivery in Europe
  • Home delivery available
  • Pick-up points in the Netherlands and France
  • Delivery times: 2 to 10 business days depending on the destination
5.1.3 Order Tracking

Each shipment is assigned a tracking number, which can be checked via:

5.2 Special Conditions During Hot Weather

Special delivery conditions apply during hot weather to maintain product quality.

5.3 Liability

La Pâte de l'Ours is not responsible for any damage occurring during transport after collection by the customer.


Article 6 – Force Majeure

La Pâte de l'Ours may be released from its obligations or suspend execution in cases of force majeure (war, riots, protests, roadblocks, traffic issues, health crises, extreme weather conditions, etc.).


Article 7 – Rental

A deposit is required for any rental of small equipment. The equipment must be returned within 5 business days after delivery, clean and in good condition.


Article 8 – Product Storage, Allergens, and Responsibilities

8.1 Storage of Chocolates and Pralines

  • Storage temperature: between 10°C and 17°C
  • Keep away from light, air, and humidity
  • If refrigeration is necessary: keep in original packaging
  • Before consumption: take out 30 minutes in advance
  • Consume within 3 weeks of purchase

8.2 Storage of Cookies

  • Store at room temperature
  • Optional reheating:
    • 10 seconds in the microwave
    • 5 minutes at 180°C in a traditional oven

8.3 Allergens

Our products are made in a workshop that processes gluten, milk, eggs, soy, sesame, nuts, and sulfites. Accidental traces of these allergens cannot be excluded. A complete list of ingredients and allergens is available via the QR code on the packaging.


Article 9 – GDPR Compliance

9.1 Data Collection

La Pâte de l'Ours collects only the data necessary for order management:

  • First and last name
  • Delivery address
  • Phone number
  • Email address

9.2 Use of Data

The collected data is used exclusively for:

  • Order processing
  • Delivery
  • Order-related communication
  • Legal and accounting obligations

9.3 Customer Rights

In accordance with GDPR regulations, customers have the right to access, correct, and delete their personal data.

Article 10 – Jurisdiction

All disputes fall under the exclusive jurisdiction of the courts of Brussels (Belgium), except for consumer sales.
